Terms of Agreement

1) Description of Service

LastHit is a personal tracking and logging tool designed to help users monitor and reduce nicotine and tobacco use. The App allows you to log cravings, track puffs, set limits, and view your progress over time. LastHit is a self-help tool and does not provide medical advice, diagnosis, or treatment.

2) Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3) Account Registration

To use the App, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Keep your login credentials secure and confidential
• Notify us promptly if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You may sign up using an email address and password or through Sign in with Apple, where available.

All purchases and subscriptions are processed by Apple. Refund requests must be submitted directly to Apple in accordance with their refund policies. We do not have the ability to issue refunds for App Store purchases. To request a refund, visit reportaproblem.apple.com.

6) User Content

You retain ownership of the data you enter into the App, including craving logs, puff counts, notes, and related information ("User Content"). By using the App, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing and improving the Service.

You are solely responsible for the accuracy and content of your User Content. We are not liable for any decisions you make based on data logged in the App.

7) Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Interfere with or disrupt the App, servers, or networks connected to the Service
• Attempt to gain unauthorized access to any part of the App or its systems
• Use the App to transmit harmful, abusive, or objectionable content
• Create multiple accounts or use the App on behalf of a third party without authorization

We reserve the right to suspend or terminate your account if you violate these Terms.

To the maximum extent permitted by applicable law, in no event shall Amol Mendonca be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or related to your use of the App.

Our total cumulative liability to you for all claims arising from or related to the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty US dollars (US $50), whichever is greater.

10) Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion. You may terminate your account at any time by deleting your account through the in-app settings.

Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Governing Law) will continue to apply.

11) Intellectual Property

The App, including its design, code, graphics, logos, and all related content, is the intellectual property of Amol Mendonca and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

12) Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in the State of California.

13) Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the Effective Date above and may provide additional notice in the App or on our website. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

14) Apple App Store Terms

The following additional terms apply if you downloaded the App from the Apple App Store:

• These Terms are between you and Amol Mendonca, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• In the event of a failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
